Climbing Crops is operated by Bexamy Pty Ltd as trustee for the Meager Family Trust ("we", "us", "our"). These Terms govern your use of the Climbing Crops website and its free and paid features.
1. Acceptance
By using Climbing Crops, creating an account or purchasing Premium, you agree to these Terms. If you do not agree, please do not use the service.
2. Eligibility and your account
You must be able to form a binding contract to buy Premium, and if you are using Climbing Crops on behalf of an organisation you confirm you have authority to do so. Keep your sign-in details confidential and give us accurate contact information. You are responsible for activity under your account. Tell us promptly at hello@climbingcrops.com if you believe it has been used without your permission.
3. What Climbing Crops provides
Climbing Crops is an online planning tool for vertical edible gardens. It provides a crop library, growing guides and planners that estimate plant numbers, spacing, support needs and climate suitability from the information you enter.
4. Free and paid features
The crop library, guides and the single-crop planner are free to use. Climbing Crops Premium is a one-time purchase that unlocks mixed-crop planning together with saving, editing and printing complete plans. Premium access is tied to the account used at checkout, is personal to you and is not transferable. If a purchase is refunded, reversed or charged back, Premium features are switched off; plans you already saved remain in your account and the free features continue to work.
5. Purchases, payment and Paddle
Paid Climbing Crops products are sold through Paddle.com. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders, handles the payment transaction, applicable taxes and buyer payment documentation, provides customer service enquiries about orders and handles returns. Bexamy Pty Ltd as trustee for the Meager Family Trust remains the supplier and operator of the Climbing Crops product and service.
Your purchase is also subject to Paddle's buyer terms. Prices are shown at checkout and may change for future purchases.
6. Refunds
We offer a 30-day money-back guarantee on Premium. Full details, including how to request a refund through Paddle, are in our refund policy.
7. Permitted use
We grant you a limited, non-exclusive, non-transferable right to use Climbing Crops for your own gardening planning, personal or business, within the features your account includes.
8. Things you must not do
- Use the service unlawfully, fraudulently or to send spam.
- Infringe our intellectual property or anyone else's.
- Interfere with the security or integrity of the service — including malware, probing, scanning, bulk scraping or attempting to bypass access controls or paid features.
- Share account credentials, resell or redistribute the service or its content.
- Reverse engineer the service except to the extent the law permits.
9. Ownership
We own the Climbing Crops software, design, branding, crop data, guides and other original content, and nothing in these Terms transfers that ownership. You keep ownership of the information you enter, such as your plan details, and you are responsible for it; you grant us the limited right to host and process it so we can provide the service to you.
10. Gardening information
Plant spacing, yields, climate ratings, support recommendations and other guidance in Climbing Crops are informational estimates based on general horticultural data and the details you enter. Real results vary with cultivar, weather, soil, microclimate, growing practices and the structures you use, so treat our figures as a starting point and follow your seed packet or plant label. You remain responsible for assessing the safety and structural suitability of your own trellises, containers and supports for the loads and conditions at your site.
11. Availability and changes
We aim to keep Climbing Crops available and accurate, but we do not guarantee uninterrupted or error-free operation. We may update, add, change or discontinue features. If we discontinue a paid feature entirely, we will give reasonable notice and, where appropriate, an appropriate remedy.
12. Suspension and termination
We may suspend or terminate access for material breach of these Terms, non-payment or payment reversal, security or fraud risk, or repeated or serious misuse. You may stop using Climbing Crops at any time and ask us to close your account, which deletes your saved plans as described in our Privacy Policy.
13. Disclaimers
To the fullest extent permitted by law, and subject to section 15, Climbing Crops is provided "as is" and we exclude implied warranties including merchantability and fitness for a particular purpose.
14. Limitation of liability
To the extent permitted by applicable law, and subject to section 15, we are not liable for indirect, consequential or special loss, including lost profits, lost crops or lost data, and our total liability arising from or in connection with Climbing Crops is limited to the amount you paid us for the service in the 12 months before the claim. Nothing here limits liability that cannot lawfully be limited, including for fraud, death or personal injury caused by negligence.
15. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or other law that cannot be excluded. Where our liability for failing to comply with a consumer guarantee can be limited, it is limited (at our option) to resupplying the service or paying the cost of having it resupplied.
16. Your indemnity
You agree to cover our reasonable losses arising from your unlawful use of Climbing Crops or your breach of these Terms.
17. Governing law
These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If you use Climbing Crops from another country, mandatory consumer protections that apply where you live are not affected.
18. Changes to these Terms
We may update these Terms from time to time. The current version is always on this page with the date it was last updated, and continued use after a change means you accept it.
